1. Agreement to Terms

By using Survpay, you agree to these Terms of Service. If you don't agree, please don't use our service.

2. Who Can Use Survpay

You must be a US resident and at least 18 years old. By signing up, you confirm you meet these requirements.

3. Your Account

Account Security: You're responsible for:

  • Keeping your email account secure (this is how you sign in)
  • Not sharing your magic link with others
  • All activity that happens on your account
  • Signing out on shared devices

4. How Survpay Works

  • Complete surveys from our partners (like BitLabs, CPX Research, and others)
  • Earn points for each completed survey
  • Cash out when you reach 500 points ($5.00)
  • Verify your identity before your first payout

5. Rules for Using Survpay

You may not:

  • Create multiple accounts
  • Provide false information
  • Use bots, scripts, or automation
  • Try to manipulate surveys or rewards
  • Share your account with others
  • Use VPNs or proxies to hide your location

Breaking these rules will result in account termination and loss of all points.

6. Points & Rewards

  • Earning Points: Points are awarded after survey completion is confirmed by our partners (typically within 24-72 hours)
  • Survey Disqualifications: You may be screened out of surveys if you don't meet the criteria. This is normal and does not affect your account or existing points
  • Point Adjustments: Survey partners may revoke or adjust points if your responses are determined to be invalid, inconsistent, or fraudulent. This is rare but necessary to maintain survey quality
  • Point Expiration: Points do not expire as long as your account remains active
  • Account Inactivity: If you don't log in for 12 consecutive months, we may close your account and forfeit remaining points after email notification
  • No Cash Value: Points have no cash value until redeemed through our payout process

7. Payouts

  • Minimum: 500 points ($5.00)
  • Verification required: Phone number and identity verification (via Stripe)
  • Processing time: Typically 3-7 business days
  • Fraud checks: We review all payouts for fraud before processing
  • Pending Payouts: If your account is terminated for fraud or rule violations, all pending payouts will be forfeited

We reserve the right to delay, withhold, or cancel payouts if we suspect fraud or rule violations.

8. Taxes

You are responsible for any taxes on your earnings. If you earn $600 or more in a calendar year, we'll send you a 1099 form. Consult a tax professional about your reporting obligations.

9. Survey Partners

We work with third-party survey providers (like BitLabs, CPX Research, and others) to bring you earning opportunities. When you take surveys, your profile information is shared with these partners to match you with relevant surveys. See our Privacy Policy for details.

10. Referral Program

If we offer a referral program, you may earn bonuses for referring friends. Referral fraud (creating fake accounts, self-referrals, etc.) will result in immediate account termination and forfeiture of all points and referral bonuses.

11. Account Suspension & Termination

By Us: We may suspend or close your account at any time if you violate these Terms, engage in fraud, or if required by law. You'll forfeit any remaining points and pending payouts.

By You: You can delete your account anytime in Settings. Important: When you delete your account, you immediately forfeit all remaining points in your wallet. Make sure to cash out before deleting your account if you have a balance.

Once an account is deleted, it cannot be restored and points cannot be recovered.

12. Changes to Survpay

We may change, suspend, or discontinue any part of Survpay at any time. We'll try to give you notice of major changes, but we're not obligated to.

13. Disclaimers

Survpay is provided "as is" without warranties. We don't guarantee:

  • Uninterrupted service or error-free operation
  • A specific number of available surveys
  • That you'll qualify for every survey
  • Specific earnings amounts
  • Survey availability in your demographic

14. Limitation of Liability

To the maximum extent permitted by law, Survpay is not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability to you won't exceed the amount of points in your account.

15. Your Responsibility

You agree to defend and hold Survpay harmless from any claims, damages, or expenses (including legal fees) arising from your violation of these Terms or misuse of the service.

16. Changes to Terms

We may update these Terms at any time. We'll post the new Terms with an updated date. Continued use means you accept the new Terms.

17. Dispute Resolution

International Users: The arbitration and class-action waiver provisions in this section do not apply to users who reside in the United Kingdom, Canada, the European Union, the European Economic Area, or any other jurisdiction where such provisions are prohibited by law.

Informal Resolution First: Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the issue through good-faith negotiations. This is a precondition to initiating arbitration or litigation.

Binding Arbitration: Except for disputes relating to Survpay's intellectual property (such as trademarks, copyrights, and patents) or if you opt out of this agreement, all claims arising out of or relating to these Terms or your use of Survpay shall be finally settled by binding arbitration administered by JAMS (Judicial Arbitration and Mediation Services) in accordance with its Streamlined Arbitration Rules and Procedures for consumer-related disputes, excluding any rules or procedures governing or permitting class actions.

The arbitrator, and not any court or agency, shall have exclusive authority to resolve all disputes arising out of or relating to these Terms. The arbitrator shall be empowered to grant whatever relief would be available in a court under the law applicable to the claims at issue, provided that the arbitrator will not have authority to award damages or relief that conflicts with these Terms. The arbitrator's award shall be binding on the parties and may be entered as a judgment in any court of competent jurisdiction.

Arbitration Location & Costs: Arbitration will take place in California, USA. For claims under $10,000, you may choose to have the arbitration conducted by telephone or based on written submissions. To the extent the filing fee for arbitration exceeds the cost of filing a lawsuit, Survpay will pay the additional cost.

Class Action Waiver: All claims must be brought in the parties' individual capacity, and not as a plaintiff or class member in any purported class, collective action, or representative proceeding. The arbitrator may not consolidate more than one person's claims or engage in any class arbitration.

This class action waiver is an essential part of this arbitration agreement. If the class action waiver is found to be illegal or unenforceable, this entire Section 17 (Dispute Resolution) will be unenforceable, and the dispute will be decided by a court rather than through arbitration.

Opt-Out Right: You have the right to opt out of this arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. Your notice must include your name, email address, and a clear statement that you wish to opt out of the arbitration agreement.

Governing Law: These Terms shall be governed by the laws of the State of California, USA, without regard to conflict of law principles. Any arbitration or court proceeding shall take place in California.
